This Bill proposes to regulate the keeping of any dog which continues to bark, bay, cry, howl, or make any other noise continuously or incessantly for a specified period of time to the disturbance of another person. It provides for enforcement of the provisions of this Article by the Animal Control Provider or duly authorized Enforcement Officer, and establishes increasing fines for a violation of and continuous violation of the barking dog provisions. This Article also defines "Responsible Party" as any person owning, harboring, or keeping a dog, with provisions relating to minors under the age of 18, including a rebuttable presumption of ownership by the person to whom a license was issued pursuant to Hawai'i Revised Statutes (HRS) 143-2. All interested persons who wish to present their comments may do so at the public hearing. Written testimonies prior to the hearing would be appreciated. NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING Notice is hereby given that the Council of the County of Kaua'i will hold a public hearing on Thursday, January 16, 2014 at 1:30 p.m., or soon thereafter, at the Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu'e, on the following: Bill No. 2517 A BILL FOR AN ORDINANCE TO ESTABLISH A NEW ARTICLE UNDER CHAPTER 22, KAUA'I COUNTY CODE 1987, AS AMENDED, ENTITLED CAT LICENSING PROGRAM The purpose of this Bill is to establish a new Article within Chapter 22, Kaua'i County Code 1987, as amended, related to establishing a Cat Licensing Program, to protect both cats and native wildlife by requiring that cats allowed to roam off their owner's property and are over four (4) months of age be sterilized and have a License. This Bill also aims to reduce the number of homeless cats, reduce the number of cats being euthanized at local animal shelters, reduce the cost to taxpayers for animal control costs, and increase the number of lost cats being reunited with their owners. This Bill establishes requirements for cats over four (4) months of age to be licensed, and to be sterilized if allowed to be at large by the owner. It sets the following fees for licenses, to be paid annually or biennially: Annual License Fee Biennial License Fee For each unneutered male cat $30 For each unneutered male cat $50 For each unspayed female cat $30 For each unspayed female car $50 For each neutered male cat $10 For each neutered male cat $15 For each spayed female cat $10 For each spayed female car $15 In addition to the License fee, the fee for a tag is Two Dollars ($2.00). Fees for redemption of an impounded cat are Twenty-Five Dollars ($25.00) for the first offense, Fifty Dollars ($50.00) for the second office, Seventy-Five Dollars ($75.00) for the third and subsequent offenses, or in lieu of paying the redemption fee, an owner may opt to have the cat sterilized by the Animal Control Provider. This Bill establishes a minimum holding period of nine (9) days for licensed cats and forty-eight (48) hours for unlicensed cats that are released to the Animal Control Provider before allowing it to be returned to the person who released it to the Animal Control Provider, offering it for adoption, or euthanizing the cat, if not sooner recovered by the owner or person claiming ownership. An impoundment fee of Twelve Dollars ($12.00) for each full day or fraction thereof will be assessed on the owner upon redemption. An additional Ten Dollars ($10.00) will be assessed for each impounded cat not licensed in accordance with this Article. This Bill proposes to allow the Director of Finance to authorize the Animal Control Provider to enforce the regulations set forth in this Article, and to issue licenses and collect license fees at its animal shelter. 97 LEGAL - Legal Notices COUNTY COST CONTROL COMMISSION 2013 Annual Report Overview Established by Charter in 1988, the goal of the Cost Control Commission is to reduce the cost of county government while maintaining a reasonable level of public services. The Cost Control Commission is charged with the responsibility to review and scrutinize personnel costs, real property taxes, travel budgets, and contract procedures with the intent of eliminating, consolidating or reducing overlapping or duplicate County services and programs. The Commission is empowered to secure, through the Office of the Mayor or the Chairman of the Council, any reports or information from their respective departments or employees that are appropriate to accomplish its work. The Cost Control Commission conducted eleven (11) regular meetings in the 2013 calendar year and is hereby submitting its Annual Report summarizing its recommendations which will be advertised as required in Section 28.05 of the Kaua'i County Charter. I. RELATING TO SPECIAL COUNSEL COSTS FOR THE COUNTY From February 2013, the Commission initiated a review of the County's special counsel contracts and expenditures. Special counsel contracts are budgeted in the Office of the County Attorney. According to County Attorney AI Castillo, he researched implementing a litigation team to reduce the cost of hiring special counsels. A wide spectrum of work has increased in the County in which it becomes difficult for the county attorney's office to service everyone all at once. Findings: 1. Maui Corporation Counsel has sixteen (16) Deputy Corporation Counsels. Eight (8) attorneys are assigned to the Litigation Division, and eight (8) attorneys are assigned to the Counseling and Drafting Division. 2. Hawai'i County Corporation Counsel has fourteen (14) Deputy Corporation Counsels (not including the 1st Deputy). A Senior Deputy Corporation Counsel supervises the attorneys assigned to both the Litigation Division and Counseling & Drafting Division. The Litigation Division consists of a Deputy Corporation Counsel Section Chief and six (6) attorneys. The Counseling & Drafting Division consist of a Deputy Corporation Counsel Section Chief and five (5) attorneys. 3. Kaua'i County Attorney's Office consists of nine (9) Deputy County Attorneys including the 1st Deputy. There is no Litigation Division at this time. 4. In 2011, the Office of the County Attorney saved the County of Kaua'i at least $500,766 by doing cases in house. 5. In 2012, the Office of the County Attorney saved the County of Kaua'i at least $314,790 by doing cases in house. 6. For Fiscal Year 2013-2014, the county would have saved $459,268 to date as only $75,000 would have been allocated for special counsel due to legal conflict issues. 7. In Fiscal Year 2012-2013, the County of Kaua'i spent approximately $1.3 million dollars for special counsel costs alone, and the cost for a two-member litigation team plus a legal clerk would have cost the County approximately $350,000 - $375,000. Recommendation: The Cost Control Commission firmly believes that hiring a two-member litigation team plus a legal clerk will save the County time and money and increase its efficiency in the County Attorney's Office. On October 14, 2013, this recommendation was sent to the Administration. The Mayor has endorsed this proposal and has sent a letter of support along with the Commission's recommendation to the Council. As of this date, the Council has not yet taken up the matter. II. The Cost Control Commission also discussed the following for 2013: ENERGY UPDATE The Commission requested information regarding energy savings regarding the Police Department located on Kaana Street. The Commission questioned the AC units running 24 hours a day, 7 days a week; what are other alternatives for the AC units to be turned off at night; and what was the cost of the AC units that are currently installed, and what will the expense be when they have to replace the AC units. Findings: 1. With 24/7 operations in the Patrol, Cell Block, and Dispatch areas, it would be difficult to determine any cost savings with trying to isolate these areas with separate AC systems. 2. Turning off AC is not an option for the Police Department. 3. The AC chillers were not a separate itemized item. The entire AC system includes the chillers, pumps, motors, AHU, pipes, etc. Unsure of the cost for the original chillers except it was probably a lot cheaper 10-years ago and less costly to install, since it was put in when the building was being constructed. 4. The current plan is to replace both of the chillers' coils at an estimated cost of approximately $200,000. That project will be going out to bid in hopes to extend the life of the chillers for another five (5) years. The chillers are eleven (11) years old and exposed to the salt air and other corrosive elements at its location. The 10+ year life for this type of exposure is normal. At its November 14th meeting the Commission received another update from Glenn Sato, Office of Economic Development Energy Manager, regarding information on the internal practices of the County. The County is working diligently on reducing its carbon footprint with all departments and agencies on the same page. The Commission was provided a working spreadsheet on the County's sustainability action plan along with strategies and goals aimed for 2023. The Commission also discussed the following matters: RELATING TO TRAVEL BUDGET RELATING TO OVERTIME VS. Non-residential improvements will include a community center, community gardens, 90 parking stalls, and walking paths. Off-site improvements include widening of Kuhi'o Highway for two left turn auxiliary lanes and bus stop turnout. Kolopua rents will be affordable to households who are at 60% and below Kaua'i's median household income. Project will feature a mix of 1, 2, and 3-bedroom units, and offer accessible units designed for tenants with mobility and sensory impairments. Location: Project is situated at 5-4280 Kuhi'o Highway in Princeville, Kaua'i, on a 3.5 acre site, and is identified by Tax Map Key (4) 5-4-024:020. Funding: HOME Investment Partnerships Program ($1,000,000.00) This Notice shall satisfy two separate but related procedural requirements for activities to be undertaken by the County of Kauai. REQUEST FOR RELEASE OF FUNDS (RROF) On or about January 15, 2014, the County of Kauai will submit a written request to the Hawaii Housing Finance and Development Corporation (HHFDC) for the release of HOME Investment Partnerships (HOME) Program funds authorized by Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended. FINDING OF NO SIGNIFICANT IMPACT (FONSI) The County of Kauai has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. OBJECTIONS TO THE RELEASE OF FUNDS HHFDC will accept objections to its release of funds and the County of Kauai's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following basis: (a) the certification was not executed by the Certifying Officer of the County of Kauai; (b) the County of Kauai has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HHFDC; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Best Management Practices (BMPs) for storm water runoff and non-storm water sources will be implemented to minimize the discharge of erosion and other pollutants from entering receiving State waters. Post construction BMPs include post construction monitoring of the harbor. The receiving waters, Pacific Ocean at Kikiaola Beach and Pacific Ocean near Mamo Road are classified by the DOH as Class A, Marine Waters, Open Coastal.
